OFFICIAL CONTEST RULES
1. The 2008 mary-kateandashley Elizabeth and James Parachute Dress Contest is sponsored by Dualstar Entertainment Group, LLC, 859 Hollywood Way, Suite 275, Burbank, CA 91505, USA ("Sponsor").
Contest Description: The 2008 mary-kateandashley Elizabeth and James Parachute Dress Contest (the "Contest") is a promotion during which individuals are invited to enter to win a tangerine Parachute dress from the Spring 2008 Elizabeth and James collection.
2. Eligible Contest Entrants: The Contest is open only to legal residents of the United States who are thirteen (13) years of age or older at the time of entry ("Entrant(s)"). Employees of Sponsor and their immediate family members-spouses, parents, siblings and children and those persons' spouses and household members ("Employees"), as well as Employees of all affiliates, dealers, subsidiaries, advertising, marketing and promotion agencies of Sponsor are not eligible to enter. Void in Puerto Rico and where prohibited or otherwise restricted by law. All federal, state, and local laws apply.
3. METHODS OF ENTRY: Complete the entry form during the contest period. You can enter the contest by completing the entry and submitting your information at www.mary-kateandashley.com. Entrants must accurately complete all required fields or entry will be deemed invalid. Entries that are lost, late, misdirected or incompletely received (including, without limitation, by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility will not be eligible. All entries become the property of Sponsor and will not be acknowledged or returned.
4. CONTEST PERIOD: The Contest begins on May 7, 2008, and ends on May 13, 2008 (the "Contest Period").
5. PRIZES: There shall be one Grand Prize winner ("Winner"), who will win a tangerine Parachute dress from the Spring Elizabeth and James collection in their appropriate size. The winning selection and the winner's name may also be identified and posted on www.mary-kateandashley.com. Prizes may not be assigned or transferred. No cash or other substitution may be made, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize with another prize of comparable or greater value. Winners are solely responsible for any and all applicable fees and taxes. If the Contest representative is unable to contact the selected Entrant that Entrant may be disqualified and an alternate Entrant may be selected. Limit of one (1) prize per person or household. The suppliers of the prizes may not necessarily be affiliated with the Sweepstakes or Sponsor. Any trademarks or names used in this promotion are the property of the respective owners and are used for identification purposes only.
6. WINNER SELECTION AND NOTIFICATION: The Winner(s) will be selected by Ashley and Mary-Kate Olsen or by a panel of judges selected by sponsor. The winners will be selected on or before May 14, 2008. The Winner(s) will be notified within 14 days of the selection date by telephone, e-mail or regular mail ("Prize Notification"). If the potential winning Entrant ("Potential Prize Winner") cannot be contacted; is ineligible; fails to claim the prize; if the Prize Notification is returned undeliverable; or if the Potential Prize Winner otherwise fails to fully comply with these official rules ("Official Rules"), he/she will forfeit the prize and an alternate winner will be chosen.
7. Participation in the Contest constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein. Potential Prize Winner(s) must comply with all terms and conditions of these Official Rules. The Potential Prize Winner(s) is not a winner until he/she have completed, signed and returned all required documentation within the time period contained in teach document, potentially including, but not limited to an affidavit of eligibility, a publicity release and/or liability release, and Sponsor has verified the Potential Prize Winner's eligibility and compliance with all Official Rules. Failure to sign and return any required documentation within the applicable time period, or provision of false or inaccurate information therein, will result in immediate disqualification. All decisions of Sponsor and/or judges shall be binding and final.
8. Release and Limitation of Liability: By participating in the Contest, Entrant agrees to release and hold harmless Sponsor, its affiliates, dealers, subsidiaries, advertising, marketing and promotion agencies and their respective parent corporations, subsidiaries, and affiliates, and the officers, directors, agents, and employees (including, without limitation, Dylan Sprouse, Cole Sprouse, Ashley Olsen and Mary-Kate Olsen) from any and all damages, injuries, claims, causes of action, or losses of any kind resulting from, arising out of or in connection with the Contest, Entrant's participation in the Contest, and/or Entrant's acceptance, possession, use, or misuse of any prize, including without limitation, personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy.
By submitting an entry, Entrant (a) represents that he or she is the sole author and creator of his or her submission, and b) grants sponsor all rights and license to review, reproduce, publish distribute, modify, publicly perform, publicly display the submission, including without limitation, the right to use the submission in any way in any media now known or hereafter discovered or devised.
Sponsor and its affiliates, dealers, subsidiaries, advertising, marketing and promotion agencies and their respective companies, parent corporations, subsidiaries, and affiliates, and the officers, directors, agents, and employees are not responsible for any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of submissions in the Contest. Sponsor does not assume responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software or failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Entrant's or to any other person's computer related to or resulting from participating in the Contest.
9. PUBLICITY: By participating in the Contest, Entrant also consents to the use of his or her name, photograph, voice, biographical information, and likeness by Sponsor or its designees in any and all media now known or hereafter devised for any purposes (including, without limitation, promotional purposes) without further payment or consideration, except as prohibited by law.
10. GENERAL CONDITIONS: Sponsor reserves the rights to terminate, cancel, suspend and/or modify the Contest if intervening circumstances warrant, within Sponsor's sole discretion due to any fraud, virus or other technical problem which corrupts the administration, or security of the Contest. In such event, Sponsor reserves the right to award the prize from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an un-sportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All interpretations of the Official Rules and decisions by Sponsor are final. Additions or deletions to the Official Rules may be made at the discretion of Sponsor and may be enacted at any time.
11. PRIVACY: Information collected from Entrants is used only for the purpose of the contest and to notify winners, and will not be re-used, sold or shared in any manner by sponsor or any third parties unless Entrant has elected to receive additional information and promotional material from Sponsor or a third party. By entering the Contest, you agree to all the terms and conditions of Sponsor's Privacy Policy, which is available at http://mary-kateandashley.com/privacy_policy.php.
12. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contests, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. To the extent permitted by law, Entrant acknowledges and agrees that the rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any Entrant expressly waives any and all such rights.
13. CONTEST RESULTS AND OFFICIAL RULES: For a copy of the Winners List or Official Rules, send the request and self addressed stamped envelope postmarked prior to May 12, 2008 to "2008 mary-kateandashley Elizabeth and James Parachute Dress Contest", attention: Dualstar Entertainment Group, LLC, 859 Hollywood Way, Suite 275, Burbank, CA 91505, USA. A list of the winners will be available after the winners have been verified and prizes have been awarded.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED.
